NGT bans mining in forest, buffer zone of Ranthambore

JAIPUR: The National Green Tribunal (NGT) in its recent order has directed that all mining activity be stopped in 409 hectare land that falls in the forest and the buffer zone of the Ranthambore National Park.

In an absolute mockery of the government of India ‘Project Tiger’, rampant illegal mining had been going on in the forest area that forms a crucial part of the tiger corridor.

In a recent order in response to the petition filed by Babulal Jajoo, the NGT has directed the respondents not carry out any mining activity in 208 hectare of land which falls under forest where mining has been stopped. A corum of five judges with Justice Swatanter Kumar as the chairperson also stayed any mining activity in 201 hectare of area which falls in the sanctuary or in its buffer zone.

“The court has stayed all mining activity by Associated Cement Companies Limited(ACC) in Lakheri in Bundi district till the company gets requisite environmental clearance, permission to operate and all other necessary permissions from the government, the supreme court and the National Board of Wildlife as the said area is a part of the tiger reserve,” said Mahendra Singh Kachhawa, advocate wildlife and environment.

According to ministry of environment & forests, the total area under mining is 1,516 hectare, out of which 1,107 area falls in the revenue land and 208 hectare is forest area in which mining has already been stopped. But, 201 hectare of land which is proposed to be used for mining purpose, undisputedly falls in the forest area in the sanctuary’s buffer zone.

Based on that, the NGT has said that the company is free to carry on mining activity in 1,107 hectare of land forming part of the revenue land, subject to compliance of all the laws in force. In the event that the company obtains all relevant permission, including permission from Wildlife Board, they may file application before the tribunal for variation of this order, if necessary.

The NGT’s fundamental grievances was that illegal and unauthorized mining activity was being carried out , particularly, in the Ranthambore National Park which is a violation of the laws in force including the Environment (Protection) Act, 1986.

“Since 2013 all mining activity being carried out is illegal. The area falls in Ramgarh Vishdhari Sanctuary, Bundi which is a part of Sawai Mansingh Sanctuary, Kawalji game reserve, Indragarh and the RTR tiger corridor. In many cases tigresses’ from Ranthambhore stays in the caves of the Vishdhari till the cubs are taken out after two months,” said Kachhawa.

But on the contrary, the ACC officials say that they have the necessary environmental clearance, permission to operate and other necessary permissions from the government. They are not carrying on any mining activity in the forest or any mining activity in the Ranthambore National Park.
